General Terms and Conditions (GTC) for orders via www.WNDRTAG.com

SCOPE OF APPLICATION

In the following we would like to present our General Terms and Conditions, which we use as a basis for the provision of all services rendered on wndrtag.com.

The offers on our website www.wndrtag.com are directed exclusively to consumers who conclude the purchase for a purpose that can be attributed neither to their commercial nor to their professional activity.

On www.wndrtag.com we offer personalized shopping and service experiences tailored to your interests and needs. On www.wndrtag.com we sell our own WNDRTAG articles.

These General Terms and Conditions (hereinafter "GTC") of Nodeu UG (haftungsbeschränkt), trading as "WNDRTAG" (hereinafter "Seller"), apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller with regard to the goods presented by the Seller in its online store. The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.

1. CONCLUSION OF CONTRACT AND DELIVERY OF GOODS
1.1 By placing an order you declare to act exclusively for private purposes.

1.2 We conclude contracts on www.wndrtag.com exclusively in German or English. You can select your preferred language via the language selection at the top of the website header or in the settings in your customer account when using the app. When ordering wndrtag articles, your contractual partner is nodeu UG (haftungsbeschränkt), Kirchstr. 17, 66957 Obersimten, and when ordering wndrtag partner articles, your contractual partner is additionally the respective wndrtag partner, about whose identity we will inform you individually on the respective product detail page.

1.3 By clicking the button "buy now" you place a binding order for the items in the shopping cart. We will confirm the receipt of your order immediately by email after sending the order. A binding contract is concluded upon receipt of the order confirmation. Please note that in case of prepayment (reservation) the delivery of the ordered goods will take place as soon as we have received the payment of the full purchase price as well as possible shipping costs. Therefore, we ask you to transfer the purchase price immediately after receipt of the order confirmation, but no later than within 7 days.

1.4 Please note that we are exceptionally not obliged to deliver the ordered goods if we have duly ordered the goods but have not been supplied correctly or in time (congruent hedging transaction). A further prerequisite is that we are not responsible for the lack of availability of the goods and that we have informed you of this circumstance without delay. In addition, we must not have assumed the risk of procuring the ordered goods. In the event of corresponding unavailability of the goods, we will immediately reimburse you for any payments already made.

1.5 We do not assume the risk of having to procure ordered goods (procurement risk). This also applies to orders for goods that are only described in terms of their type and characteristics (generic goods). We are only obliged to deliver from our stock of goods and the goods ordered by us from our suppliers. In case of orders of wndrtag partner articles, our stock of goods includes the stock of goods of the wndrtag partner. We deliver orders within Germany. If working days are specified as deadlines, we understand this to mean all days from Monday to Friday inclusive, with the exception of public holidays.

1.6 We reserve the right to refuse an order or to cancel the order if this order was generated by software, a machine, a crawler, a spider or by other automatic web programs or scipted-behaviour systems or by using services of third parties which were used to place the order on your behalf.

2. PRICES, SHIPPING COSTS AND EXPRESS DELIVERY
2.1 The prices listed in the offer at the time of the order shall apply. The prices stated are final prices, i.e. they include the applicable German statutory value-added tax. Until full payment of the purchase price, the goods remain our property.

 

3. PAYMENT
3.1 In principle, we offer the payment methods prepayment, credit card, invoice and Paypal. For each order, we reserve the right not to offer certain payment methods and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). Any costs of a money transaction are to be borne by you.

3.2 In the case of purchase by credit card, your credit card account will be charged when we ship the order.

3.3 In the case of purchase on account, you will be informed about the due date of the purchase price on the order overview page before the conclusion of the contract.

 3.4 You agree that you will receive invoices and credit notes exclusively in electronic form.

4. LEGAL RIGHT OF REVOCATION FOR WNDRTAG ITEMS
YOU HAVE A STATUTORY RIGHT OF REVOCATION FOR THE PURCHASE OF WNDRTAG ITEMS:
CANCELLATION POLICY:
You have the right to revoke this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods or, in the case of partial deliveries, the last delivery. To exercise your right of withdrawal, you must inform Nodeu UG (haftungsbeschränkt), Kirchstr. 17, 66957 Obersimten, e-mail: service@wndrtag.store by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample cancellation form for this purpose. However, this is not mandatory. You can also fill out and submit the model withdrawal form or another clear declaration electronically via the contact form on our website. If you make use of this option, we will immediately send you (e.g. by email) a confirmation of receipt of your revocation. To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation If you revoke this contract, we shall reimburse you all payments we have received from you, excluding delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the costs of returning the goods. You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.

End of the cancellation policy

Attention: The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

 

5. LEGAL RIGHT OF REVOCATION FOR WNDRTAG-PARTNER-ARTICLES AND WNDRTAG-ARTICLES
WHEN PURCHASING WNDRTAG-PARTNER-ARTICLES AND WNDRTAG-ARTICLES, YOU ARE ENTITLED TO A LEGAL RIGHT OF REVOCATION:

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

6. REFUNDS
We will automatically arrange for any refunds to be made to the account used by you for payment. If you have paid by invoice and prepayment, the refund will be instructed to the account from which the transfer was made. If you have paid by Paypal or credit card, the refund will be made to the associated Paypal or credit card account. If you have used a gift voucher with your purchase, we will credit the corresponding amount to your gift voucher account.

8. LEGAL LIABILITY FOR DEFECTS AND FURTHER INFORMATION
8.1 The legal liability for defects applies.

8.2 The use of the offers available on www.wndrtag.com is possible for persons who are at least 18 years old.

8.3 Each customer is only entitled to maintain one customer account with Wndrtag at the same time. We reserve the right to delete multiple registrations.

8.4 You can view these Terms and Conditions at www.wndrtag.com. In addition, you can print or save this document by using the usual function of your internet service program (=browser: there usually "File" -> "Save as"). You can also download and archive this document in PDF form by clicking here. To open the PDF file, you will need the free program Adobe Reader (at www.adobe.de) or comparable programs that can handle the PDF format.

8.5 You can also additionally archive the GTC as well as the data of your order simply by either downloading the GTC and saving the data summarized on the last page of the order process in the Internet store with the help of the functions of your browser or by waiting for the automatic order confirmation, which we will additionally send to you by e-mail after completion of your order to the e-mail address provided by you. This order confirmation e-mail contains once again the data of your order and our terms and conditions and can be easily printed or saved with your e-mail program.

8.6 The European Commission provides a platform for online dispute resolution (OS), which you can find under the link to the platform of the European Commission. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
